General Provisions
This privacy policy (hereinafter referred to as the Policy) of LLC "MKS Innovations" (hereinafter referred to as the Site Administration) is an integral part of the User Agreement posted and available on the Internet at https://cval.ai, as well as other contracts concluded with the User when this is directly provided for by their terms.
In accordance with applicable law, this Policy establishes the types of information that the Site Administration may collect during your use of the Site services (hereinafter referred to as the Services), including personal data (hereinafter referred to as Personal Information), as well as the rules for its use.
The Site Administration is committed to maintaining your confidentiality on the Internet, as well as protecting and processing your Personal Information in strict compliance with the legislation of the Russian Federation.
The terms from the User Agreement are used in this Policy.
Procedure for Collecting and Using Personal Information
To ensure the use of the Services, your Personal Information is collected and used by the Site Administration – a legal entity created in accordance with the legislation of the Russian Federation and registered at the address: Novosibirsk region, Novosibirsk city, Gorsky district, house 67, apartment 225.
The Site Administration may collect the following categories of Personal Information about you while you use the Site and/or Services:
- when filling out the "Feedback" form, such as – name, surname, contact phone number, email address;
The Site Administration does not intentionally collect sensitive personal information (such as racial origin, political opinions, health information, and biometric data). However, you may voluntarily provide them to the Site Administration, and in this case, the Site Administration will process them as part of providing you with the Services. You should bear in mind that the Site Administration cannot request your consent for such processing since it is not aware in advance of the potentially sensitive nature of the Personal Information you may provide.
Methods of Processing Personal Data, Legal Basis
The Site Administration is entitled to use, including the following methods of processing personal data: collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (provision, access), blocking, deletion, destruction of personal data.
The Site Administration is not entitled to process your Personal Information without sufficient legal grounds. The Site Administration processes your Personal Information only in the following cases:
- processing is necessary for the fulfillment of contractual obligations to you, including ensuring the operation of the Site and Services;
- processing is necessary to comply with legal obligations;
- processing is necessary to ensure the legitimate interests of the Site Administration if such processing does not significantly affect your interests, your fundamental rights, and freedoms for the purpose of:
- better understanding how you interact with our Site and/or Services;
- improving and enhancing the Site and/or Services for the benefit of all Site users;
- forming offers to you regarding other products, services, and services that may interest you (i.e., publishing information on the Site).
- achieving specific results or, in accordance with the requirement of applicable legislation, we may request your separate consent for processing your Personal Information. For jurisdictions where consent is recognized as a separate legal basis, starting to use the Site and/or Services expresses your consent to such processing. Hereby, we inform you, and you acknowledge that you have no obligation to provide us with any Personal Information when using the Site and/or Services and it is based solely on your free will. At the same time, you realize that without providing Personal Information, we will not be able to provide you with the opportunity to use the Services, and your use of the Site will be limited.
When processing your Personal Information, the Site Administration always strives to maintain a balance between its legitimate interests and protecting your privacy.
The Site Administration processes your Personal Information for the following purposes:
- providing you access to the Site and/or Services;
- providing access to your account if you are registered in the respective Services;
- communication with you to send you notifications, requests, and information related to the operation of the Site and Services, the execution of agreements with you, and the processing of your applications;
- increasing the convenience of using the Sites and Services;
- collecting, processing, and presenting statistical data, big data, and other research (exclusively in an anonymized form).
Protection of Personal Information
In most cases, Personal Information is processed automatically without access to it by any of the Site Administration's employees.
If such access is necessary, it may be provided only to those employees of the Site Administration who need it to perform their official duties. For the protection and confidentiality of data, all employees of the Site Administration adhere to internal rules and procedures regarding the processing of Personal Information, follow all technical and organizational security measures in place to protect your Personal Information.
All employees of the Site Administration are familiarized under signature with the requirements of the Information Security Regulations and strictly comply with them.
The Site Administration has implemented sufficient technical and organizational measures to protect Personal Information from unauthorized, accidental, or illegal destruction, loss, alteration, misuse, disclosure, or access, as well as other illegal forms of processing. These security measures have been implemented taking into account the modern level of technology, the cost of implementation, the risks associated with processing, and the nature of the Personal Information and include conducting regular events:
- regular updates of services and systems for managing the Site and its content;
- encryption of archival copies of the resource;
- regular checks for the presence of malicious codes;
- the use of a virtual dedicated server for hosting the Site;
- and others.
Duration of Personal Data Storage
The Site Administration stores your Personal Information for as long as necessary to achieve the purpose for which it was collected, or to comply with the requirements of legislation and regulatory acts, but in any case no longer than 3 years from the date of cessation of service use or no more than 3 years from the date of data collection if the Site User is not registered in the service.
Upon your request for the deletion of Personal Information, sent to the address of the Site Administration, the Site Administration carries out the activities for its deletion in accordance with the requirements of the legislation of the Russian Federation.
Transfer of Personal Information
The Site Administration does not transfer the Personal Information of the Site User to third parties, except in cases when it is required:
- compliance with the legislation of the Russian Federation;
- compliance with a regulatory legal act of the Russian Federation;
- execution of a court decision;
- detection or prevention of fraud;
- elimination of technical malfunctions in the operation of the site;
- providing information based on the request of authorized government bodies.
The Site Administration does not use your Personal Information for electronic distribution of news and special offers, execution and conducting of a trade transaction, and provision of services through the Services.
Your Rights
The Site User has the right:
- to access your Personal Information processed by the Site Administration in accordance with this Policy, if this is provided by the current legislation of the Russian Federation.
- to make changes to Personal Information independently or upon request, if you believe that any information the Site Administration stores about you is incorrect or incomplete.
- to request the deletion of your Personal Information or part of it, as well as to withdraw consent to the processing of your Personal Information;
- to request restrictions on the processing of your Personal Information;
- to object to the processing of your Personal Information if this is provided by applicable legislation.
In cases provided by applicable legislation, you may also have other rights not listed in this section.
If you are not satisfied with how the Site Administration processes your Personal Information, please inform us (info@cval.ai), and we will consider your claim. If you are not satisfied with the response of the Site Administration, you have the right to file a complaint with the competent authority in accordance with the current legislation.
Updating this Policy
Changes may be made to this Policy by the Site Administration.
The Site Administration has the right to make changes at its discretion, including but not limited to, cases when the relevant changes are related to changes in applicable legislation, as well as when the relevant changes are related to changes in the operation of the Site and Services.
